1. Agreement to Terms

By accessing or using Family Press (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service. The Service is provided by Family Press, an Australian business.

2. Description of Service

Family Press is a subscription-based service that allows you to create printed family newsletters from voice recordings, text, and photos. Depending on your plan, newsletters can be downloaded as PDFs for home printing or professionally printed and posted to your nominated recipients.

3. Accounts and Registration

  • You must be at least 16 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect any unauthorised use of your account.

4. Subscriptions and Payment

  • Paid plans are billed monthly or annually in advance, in Australian Dollars (AUD) unless otherwise indicated.
  • Prices are inclusive of GST where applicable.
  • You may cancel your subscription at any time. Access continues until the end of your current billing period.
  • We reserve the right to change our pricing with 30 days' notice.
  • Refunds for printing and postage costs are not available once a newsletter has been sent for printing.

5. Your Content

You retain ownership of all content you upload or create through the Service (including voice recordings, text, and photos). By using the Service, you grant us a limited licence to:

  • Process, format, and print your content for the purpose of delivering your newsletters.
  • Transcribe voice recordings into text.
  • Store your content securely for the duration of your account.

We will not use your content for marketing purposes, share it publicly, or sell it to third parties.

6. Acceptable Use

You must not use the Service to:

  • Send newsletters containing unlawful, defamatory, harassing, or offensive content.
  • Infringe on intellectual property rights of others.
  • Send unsolicited newsletters to people who have not consented to receive them.
  • Impersonate another person or misrepresent your identity.
  • Attempt to disrupt, compromise, or gain unauthorised access to our systems.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Printing and Delivery

  • For Premium and Family Circle plans, we arrange printing and postal delivery of your newsletters through third-party print and mail partners.
  • Delivery times depend on your recipient's location and are estimates only. We are not responsible for postal delays beyond our control.
  • You are responsible for ensuring recipient postal addresses are accurate and current.
  • Print quality may vary slightly from on-screen previews due to differences between screen and print colour profiles.

8. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, our liability to you for any loss or damage arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, or consequential loss, including loss of data, revenue, or anticipated savings. Nothing in these Terms excludes or limits your rights under the Australian Consumer Law where they cannot be excluded.

9. Termination

You may close your account at any time through your account settings or by contacting us. Upon termination:

  • Your access to the Service will cease at the end of your current billing period.
  • Your content will be retained for 30 days, after which it will be permanently deleted.
  • We may retain anonymised usage data for analytical purposes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service will be subject to the jurisdiction of the courts of Australia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on our website at least 14 days before they take effect. Your continued use of the Service after the updated Terms take effect constitutes acceptance.
